Fair Use Policy

About this policy
Blutui is designed to grow with the sites you build. Spike & Scale lets your Projects handle campaign launches, media coverage and seasonal peaks without you having to predict traffic in advance. This Fair Use Policy explains how we expect the Services to be used so that performance stays fast and reliable for every agency on the Platform.
This policy forms part of the Blutui Terms and Conditions (blutui.com/legal/terms-and-conditions) and applies to every account, Authorised User and Project on the Blutui Platform, on every Plan. Capitalised terms have the meanings given in the Terms.
This policy is about how much of the Services you use and how you use them. What you publish and how you behave on the Platform is covered by our Acceptable Use Policy at blutui.com/legal/acceptable-use-policy.
What fair use means
Fair use means using the Services to build, host and run websites, microsites and campaign landing pages for your agency and your Agency Clients, at a level consistent with the Project Pricing Tier each Project is on.
Normal growth and temporary increases in traffic are fair use. A Project that goes viral, runs a big campaign or has a busy launch week is exactly what Spike & Scale is for. Usage above a Project's Included Usage is handled through Overage Charges and tier changes under Section 3.4 of the Terms, and is not by itself a breach of this policy.
Usage that is not fair use
You must not use the Services, and must not allow any Authorised User, automated system or other person to use the Services, in any of the following ways.
Using Projects for something other than a website
Using a Project mainly as file storage, a backup or archive, or a download or distribution service, rather than as a website.
Using a Project to host or stream large media files, software downloads or datasets that are not part of the website itself.
Using the Services as a content delivery network or image host for sites or applications hosted somewhere else.
Automated and programmatic use
Sending automated requests, including from bots, spiders, scrapers or scripts, at a volume or frequency that goes beyond what a Project or integration reasonably needs.
Load testing, stress testing or benchmarking the Services or any Project without our prior written permission.
Making API calls at a rate that degrades the Services for other customers, or ignoring any rate limit we apply.
Running resource-intensive processes that are not needed to operate a website, such as cryptocurrency mining.
Getting around your Plan or Project Pricing
Splitting one website across several Projects, or combining several websites into one Project, to avoid the Project Pricing Tier the site would otherwise need.
Using a Development Project to serve a live website to the public. Development Projects are for building, staging and client review, as set out in Section 3.3 of the Terms.
Sharing log-in credentials between several people to avoid paying for additional seats, except as permitted under Section 2.4 of the Terms.
Any other use intended to avoid fees or exceed usage limits, as set out in Section 7.5 of the Terms.
Usage that harms the Platform
Usage that places an unreasonable or disproportionate load on our infrastructure, or that affects the performance, availability or security of the Services for other customers.
Automated systems and integrations
You are welcome to connect third-party services, applications and automated systems to the Blutui Platform, including through our APIs, for legitimate work on your Projects. You are responsible for those connections and for the activity they generate, as set out in Sections 1.2 and 2.1 of the Terms. If you plan an integration that will generate a high volume of requests, please talk to us first so we can make sure it runs smoothly.
Planning for high traffic
If you are expecting a significant campaign, launch, media event or other activity likely to increase a Project's usage, let us know at support@blutui.com. We can help you choose the right Project Pricing Tier and make sure the Project is ready.
How we measure usage
We measure usage with our own monitoring systems, as set out in Section 3.4.9 of the Terms. We may look at each type of usage, including bandwidth, storage and request volume, and at the pattern of usage over time, when deciding whether usage is fair.
How we respond
In most cases we will contact you first, explain what we have seen and work with you to fix it. Depending on the situation, we may:
recommend or apply a more suitable Project Pricing Tier, in accordance with Section 3.4 of the Terms;
ask you to reduce or change the usage within a reasonable period;
limit the rate of requests to a Project or to our APIs; and
suspend access to all or part of the Services, as set out in Section 4 of the Terms, where the usage continues or poses a risk to the Services or other customers.
Where usage poses an immediate risk to the security, performance or availability of the Services, we may act straight away and contact you as soon as we reasonably can. Fees remain payable for any period of suspension, as set out in Section 4.2 of the Terms.
Changes to this policy
We may update this policy from time to time. We will publish the updated version at blutui.com/legal/fair-use-policy and give notice of changes in accordance with Section 11 of the Terms. If this policy is inconsistent with the Terms, the Terms prevail.
