About this policy
Blutui is built for agencies and creative practitioners who care about craft, quality and purpose in digital work. This Acceptable Use Policy sets out what you can and can't do with the Blutui Platform, so that it stays a trusted place for you, your clients and everyone who visits the sites you build.
This policy forms part of the Blutui Terms and Conditions (blutui.com/legal/terms-and-conditions) and applies to every account, Authorised User and Project on the Blutui Platform, on every Plan. Capitalised terms have the meanings given in the Terms.
Prohibited content and activities
You must not use the Services, and must not allow any Authorised User or other person to use the Services, to create, host, publish or distribute content, or carry out activity, that falls into any of the categories below.
Intellectual property
Content that infringes copyright, trade marks or any other intellectual property right of another person.
Content you do not have the right to use, including images, fonts, code or media used without an appropriate licence.
Domain squatting, including registering, connecting or using a domain name that is identical or confusingly similar to another person's name, brand or trade mark in bad faith, for example to sell it back to them, divert their traffic or mislead visitors. This includes misspelt versions of a brand or website name (typosquatting).
Username squatting, including registering or holding an account name, username, workspace name, Project name or subdomain on the Blutui Platform that uses another person's name, brand or trade mark in bad faith, for example to block them from using it, sell it to them or impersonate them.
Spam, deception and fraud
Sending unsolicited bulk messages or spam, or hosting content promoted through spam.
Phishing, or any site or message designed to trick people into giving up passwords, payment details or personal information.
Impersonating any person, business or organisation, or falsely implying an affiliation with them.
Misleading or deceptive marketing or advertising, including fake reviews or endorsements.
Any fraudulent activity, including using stolen or unauthorised payment methods.
Security and the integrity of the Services
Circumventing or attempting to circumvent any security, authentication or access control measure.
Probing, scanning or testing the vulnerability of the Services or any related system without our prior written permission.
Introducing malware, viruses or other harmful code, or carrying out denial-of-service or similar attacks.
Selling, transferring or sharing log-in credentials, except as permitted under Section 2.4 of the Terms.
Reverse engineering the Services, or reselling them except under a separate written agreement with us, as set out in Section 7.5 of the Terms.
Illegal activity
Content or activity that is unlawful in New Zealand or in any place where the content is accessed or the activity takes place.
Promoting, facilitating or offering illegal goods or services.
Use of the Services by or for any person subject to sanctions, as set out in Section 12.6 of the Terms.
Harmful content
Content that promotes hatred, discrimination or violence against any person or group based on a protected characteristic.
Content that threatens, harasses, bullies or abuses any person.
Excessively violent, sexually explicit or obscene material.
Content that exploits or endangers children in any way.
Misrepresentation of your business
Misrepresenting who you are or the nature of your business when you sign up or use the Services, including falsely presenting yourself as an agency or as part of another organisation. The Services are provided to digital, creative, web and marketing practitioners, agencies and studios, as set out in Section 2.6 of the Terms.
Made-For-Advertising websites
We stand firmly against Made-For-Advertising (MFA) websites. An MFA website is a site created mainly to generate advertising impressions or revenue, without delivering genuine content, brand value or usefulness to the people who visit it. These sites drain advertiser budgets and add noise to the web, and they have no place on Blutui.
We have a zero-tolerance approach:
MFA websites are not permitted on the Blutui Platform.
Any MFA website we detect or receive a credible report about will be taken offline immediately.
Accounts responsible for MFA websites may be suspended or terminated, and attempts to get around this policy may result in permanent removal from the Platform.
Your responsibilities
You are responsible for all content published through your account and for the conduct of your Authorised Users, including anyone you give client-side editing access. If you become aware that any content or activity under your account breaches this policy, you must remove it or stop it promptly and let us know.
This policy covers what you publish and how you behave on the Platform. How much of the Services you use, including bandwidth, storage and automated or programmatic traffic, is covered separately by our Fair Use Policy at blutui.com/legal/fair-use-policy.
Reporting a breach
If you see content or activity on a Blutui-hosted site that you believe breaches this policy, including an MFA website or content that infringes your rights, please email abuse@blutui.com with the web address concerned and a short description of the issue. We review every report and act quickly where action is needed.
How we respond
When we become aware of a possible breach, we may:
investigate, and ask you for information to help us do so;
remove or disable access to the content concerned, as set out in Section 1.8 of the Terms;
suspend access to all or part of the Services, as set out in Section 4 of the Terms; and
terminate your account in serious or repeated cases, as set out in Section 5 of the Terms.
Where we can, and where the law allows, we will tell you what action we have taken and why. Where a breach poses a risk to the Services, to other customers, to Site Visitors or to the public, we may act immediately and without notice. Fees remain payable for any period of suspension, as set out in Section 4.2 of the Terms.
Changes to this policy
We may update this policy from time to time. We will publish the updated version at blutui.com/legal/acceptable-use-policy and give notice of changes in accordance with Section 11 of the Terms. If this policy is inconsistent with the Terms, the Terms prevail.
